These Terms & Conditions ("Terms") govern your access to and use of Zenvestor (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.
1. Introduction
Zenvestor is a software service operated by an individual developer based in Spain ("Zenvestor", "we", "us"). Zenvestor provides tools that allow users to automate cryptocurrency investment actions on third-party exchanges, based on parameters defined by the user.
By creating an account or using the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with these Terms, you must not use the Service.
2. Eligibility
By using the Service, you represent and warrant that:
- You have the legal capacity to enter into a binding agreement.
- You are legally permitted to use the Service and to trade or invest in digital assets in your jurisdiction.
You are solely responsible for ensuring that your use of the Service complies with applicable laws and regulations.
3. Nature of the Service
Zenvestor is a non-custodial automation tool.
- Zenvestor does not hold user funds.
- Zenvestor does not execute withdrawals.
- Zenvestor does not act as a broker, exchange, or financial intermediary.
- Zenvestor does not provide investment, tax, or financial advice.
All investment decisions, including asset selection, amounts, frequency, and duration, are made solely by the user.
4. Automated Execution & User Responsibility
Zenvestor executes actions strictly according to the parameters configured by the user.
This may include:
- Scheduling recurring executions.
- Automatically adjusting execution amounts to comply with user-defined limits.

Automatically stopping an investment plan when predefined conditions are met, such as:
- A maximum budget being fully consumed.
- A maximum number of executions being reached.
These behaviors are mechanical safeguards reflecting user intent and do not constitute discretionary or strategic investment decisions.
The user remains responsible for:
- Monitoring their investment plans.
- Pausing, modifying, or stopping automation when desired.
- Revoking API access if they no longer wish to use the Service.
Zenvestor does not assess market conditions, does not evaluate the suitability of any strategy, and does not determine whether an investment should or should not be made.
5. Risks & No Guarantee of Results
Investing in digital assets involves significant risk, including the potential loss of capital.
You acknowledge that:
- Cryptocurrency markets are volatile.
- Automated investing may result in repeated or systematic executions over time.
- Depending on market conditions and user-defined parameters, automation may increase exposure to market volatility compared to manual or one-off trades.
Zenvestor does not guarantee:
- Execution success.
- Execution timing.
- Execution price.
- Profitability or avoidance of loss.
Past performance does not guarantee future results.
6. Third-Party Exchanges & API Keys
Zenvestor interacts with third-party cryptocurrency exchanges designated by the user via API keys.
You are solely responsible for:
- Creating and managing API keys.
- Choosing appropriate permissions.
- Ensuring API keys remain valid.
- Revoking API access when necessary.
Zenvestor is not responsible for third-party exchange behavior, including but not limited to outages, API changes, operational constraints, fee structures, order execution policies, or account restrictions.
Zenvestor does not request withdrawal permissions and cannot access or move user funds outside of exchange-executed trades.
7. Execution Failures
Executions may fail, partially execute, or be delayed due to factors outside of Zenvestor's control, including but not limited to:
- Third-party exchange behavior or constraints.
- Technical or operational limitations.
- User configuration choices.
- Market conditions or liquidity constraints.
Zenvestor makes reasonable efforts to report execution outcomes but does not guarantee completeness, accuracy, or real-time reporting.
8. Pricing, Paid Features & Payments
Certain features of the Service may be offered free of charge, while others may be subject to fees.
Pricing, billing terms, and feature availability are described on the Service at the time of purchase and may change over time.
Payments for paid features, if applicable, may be processed by a third-party Merchant of Record. In such cases, the Merchant of Record is responsible for payment processing, invoicing, and applicable taxes, in accordance with their own terms and policies.
9. Data & Privacy
Zenvestor collects and processes personal and investment-related data solely for the purpose of providing and operating the Service. This includes executing user-configured investment plans, maintaining account state, and providing execution history and reports.
Zenvestor does not sell, rent, or monetize user data, whether personal or investment-related. User data is not shared with third parties for advertising, profiling, or resale purposes.
Data may be shared with third-party service providers strictly as necessary to operate the Service, such as authentication providers, hosting services, email delivery services, and cryptocurrency exchanges designated by the user.
If the user terminates their account, Zenvestor will delete personal data and associated investment data within a reasonable timeframe, except where retention is required for legal, security, or operational purposes.
Zenvestor processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
10. Suspension & Termination
You may stop using the Service and terminate your account at any time.
Zenvestor reserves the right to suspend or terminate access to the Service if:
- These Terms are violated.
- The Service is used in an abusive, fraudulent, or unlawful manner.
- Continued operation would pose legal, security, or operational risks.
11. Limitation of Liability
To the maximum extent permitted by law, Zenvestor shall not be liable for:
- indirect, incidental, or consequential damages.
- losses resulting from market movements, third-party exchange behavior, or user configuration choices.
Zenvestor's total liability, if any, shall not exceed the fees paid by the user for the Service during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Modifications to the Terms
Zenvestor may update these Terms from time to time.
Material changes will be communicated to users, and continued use of the Service after such changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain.
If the user is considered a consumer under applicable law, mandatory consumer protection rules of the user's country of residence may also apply.
Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts under applicable law.
